1. Purpose of Service
We provide prospective residents with access to self-guided tours of our rental communities. By scheduling or participating in a self-guided tour, you agree to these Terms & Conditions.
2. Eligibility
You must be at least 18 years of age (or the legal age of majority in your state) to participate.
A valid government-issued photo identification (“ID”) is required for verification prior to access.
3. Collection & Storage of Identification
We securely collect and store a copy of your ID/license solely for the purpose of identity verification, fraud prevention, security, and compliance with applicable housing regulations.
Your ID/license may be stored in our database for as long as reasonably necessary to provide services, resolve disputes, enforce agreements, and comply with applicable law.
4. Data Removal / Opt-Out
You may request deletion of your stored ID/license information at any time by emailing us at [email protected].
Upon receipt of a verified request, we will delete your information from our active database unless retention is required by law (e.g., fraud prevention, compliance, dispute resolution).
5. State-Specific Disclosures
California Residents: We comply with the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA). You may request to know what information we collect, request deletion, or opt-out of sale/sharing of your personal information by emailing us at [email protected].
Other States: Similar rights may be available under the privacy laws of your state (including Colorado, Connecticut, Virginia, Utah, and others). We will honor requests consistent with applicable state laws.
Where applicable law prohibits long-term storage of license information, we retain data only as allowed and delete when no longer necessary.
6. Access & Security
Tour access is provided via secure codes, smart locks, or lockboxes.
You agree not to share your access code or otherwise allow unauthorized persons to enter the property.
7. Assumption of Risk & Liability
By entering the property, you assume all risk of injury or damage to yourself, your guests, and your belongings.
You agree that access is provided “as is” and “as available,” without any warranties of any kind, express or implied.
To the fullest extent permitted by law, My Smart Tour is not liable for any damages, losses, claims, or issues of any kind, whether direct, indirect, incidental, consequential, or otherwise, arising out of or related to your participation in a self-guided tour.
This includes, without limitation, personal injury, property damage, theft, technical errors, access issues, or any other occurrence before, during, or after the tour.
8. Modification of Terms
We may update these Terms from time to time. Continued use of our self-guided tour service constitutes acceptance of updated terms.
